Terms of Service

GOLD SERVICE CONTRACT

This Gold Service Contract (“Contract”) is entered into by and between Dreifuss Fireplaces (“Service Provider”) and you, (“Client”), collectively referred to as the “Parties”.

1. Service Scope

The Service Provider agrees to provide the Client with comprehensive maintenance and repair services for fireplaces and garage doors under the Gold plan, which includes:

    1. One (1) fireplace service and one (1) garage door service call per year.
    2. Gold Priority scheduling service for emergencies. This consists of head of line scheduling ahead of other customers or new customers on service calls
    3. Five percent (5%) discount on parts for fireplace and garage doors.
    4. Five percent (5%) discount on the purchase of new fireplaces and garage doors.

 

2. Pricing

The Client agrees to pay for the Gold plan at the rate of $39.95 per month or an annual payment of $455.43 is available for a 5% discount off the monthly rate.The normal price of these services is $648.99.

3. Term

This Contract shall commence upon initial purchase and shall continue on a month-to-month basis. The Client may opt for an annual term, which shall commence upon initial purchase and end one (1) year thereafter, with automatic renewal unless canceled by either party with thirty (30) days written notice.

4. Payment

Monthly payments are due on the same day of the month, which is the date of sign-up. Annual payments are due in full on the commencement date of the annual term. Late payments may incur late fees at a rate of 18% APR, or the max allowed by law.

5. Service Details

Maintenance calls include inspections, lighting and turning off pilot lights, and other preventative maintenance activities. 

Service calls include problems which do not allow the fireplace or garage door to operate as intended. 

Fireplace Cleaning includes general clean-up of logs, burner beds, and other components of a fireplace. This does not include the chimney or components outside of the fireplace frame. 

Discounts applicable to parts and new purchases of fireplaces and garage doors.

6. Cancellation

Either party may terminate this Contract with thirty (30) days written notice. If the Client cancels before the end of the annual term, any discounts received will be charged back to the Client.

7. General Provisions

This Contract contains the entire agreement between the Parties. Any amendments must be in writing and signed by both Parties. This Contract is governed by the laws of Philadelphia, Pennsylvania.

8. Minimum Commitment and Early Termination

Minimum Commitment: The Client agrees to a minimum commitment period of twelve (12) months for the Gold plan. This commitment period is designed to ensure that the Service Provider can deliver the comprehensive services offered under the plan without incurring losses due to early termination.

Early Termination by Client: If the Client chooses to terminate this Contract before the end of the minimum commitment period, except where termination is due to the Service Provider’s failure to provide the agreed services, the Client will be subject to an early termination fee. This fee will be calculated as the difference between the normal price of services already rendered and the discounted price provided under the plan, plus a termination fee of $29.99, to cover administrative costs and potential losses incurred by the Service Provider.

Exceptions: Termination of this Contract by the Client without penalty is permitted under the following conditions:

  1. The Service Provider fails to provide the services at the agreed standards or within reasonable time frames.
  2. Relocation of the Client outside of the Service Provider’s operational area, with proof of relocation provided.
  3. Significant changes to the services or terms of this Contract made by the Service Provider that materially affect the Client.

 

Notice of Termination: To terminate this Contract, the Client must provide the Service Provider with written notice of termination, clearly stating the reason for termination and the desired end date of the services, subject to the terms outlined in this section.

PLATINUM SERVICE CONTRACT

This Platinum Service Contract (“Contract”) is entered into by and between Dreifuss Fireplaces (“Service Provider”) and you, (“Client”), collectively referred to as the “Parties”.

1. Scope of Service

The Service Provider agrees to provide the Client with comprehensive maintenance and repair services for fireplaces and garage doors under the Platinum plan, which includes:

    1. Two (2) fireplace service (spring and fall) and one (1) garage door service (up to 2 doors) calls per year, plus one (1) emergency service call throughout the year.
    2. Platinum Priority scheduling service for emergencies. This consists of head of line scheduling ahead of all customers on service calls.
    3. Free priority shipping on part orders.
    4. Ten percent (10%) discount on parts for fireplace and garage doors.
    5. Ten percent (10%) discount on the purchase of new fireplaces and garage doors.
    6. Fireplace Glass Protection Plan option (additional charges apply based on size). 
    7. Multiple fireplace discounts for each additional fireplace.
    8. Multiple garage door discounts for each additional garage door.

 

2. Pricing

The Client agrees to pay for the Platinum plan at the rate of $59.95 per month or an annual payment of $683.45 is available for a 5% discount off the monthly rate. Additional fireplaces can be included for $14.99/each per month. The normal price of these services is $947.99.

Emergency Services covering the first hour of labor. Calls include problems which do not allow the fireplace or garage door to operate at all. Limit one (1) visit per household, per year. Parts not included. Next business day. Limit one (1) visit per household, per year. 

Discounts applicable to parts and new purchases of fireplaces and garage doors. 

Fireplace Glass Protection Plan: Optional coverage for damage consisting of chips, cracks, and other accidental damage. Does not cover improper installation or usage, vandalism, or intentional damage. Monthly charges based on glass size. Limit one (1) per year. 

Multiple fireplace discounts apply to services for additional fireplaces at the specified rates. 

Multiple garage door discounts apply to services for additional garage doors at the specified rates.
